The situation
Roman Maskalevich, a client living in Poland, lost €4,300 to a fake broker operating as Fintxpert. Following instructions from an “analyst”, he made four transfers to personal bank cards.
There was no contractual legal entity to pursue as a broker. A chargeback was not available for these transfers.
The legal approach
The lawyers brought an unjust-enrichment claim against the cardholder who received the money. Together with the claim, they requested an immediate interim freeze of the recipient’s assets.
Action taken
The court granted interim protective measures and froze the relevant accounts. This prevented the recipient from freely disposing of the funds while the dispute was being pursued.
Outcome
The defendant repaid the full €4,300 to the client.
This outcome reflects the particular facts and measures available in this case. It does not establish that a similar transfer can always be recovered.
